MORE NONSENSE ON THE DEATHS OF THE BROTHERS HUSSEIN
This editorial in the guise of a news article alleges the combat deaths of Uday and Qusay were
illegal assassinations. There are many problems with this thesis to say the least..
First, the reporter/pontificator is defining " assassination" as any action, including a military attack during wartime, that results in the death of a foreign leader, an absurdly broad interpretation of
President Ford's executive order and one favored by
crackpot leftist international lawyers. Evidently they never heard of
Admiral Yamamoto.
Secondly,Uday and Qusay, for all their terrible abuses of power were neither the head of state nor the head of government in Iraq so even if we accept the above interpretation, they aren't covered under the assassination ban.
Thirdly, an executive order is exactly that. It is neither a law nor part of the UCMJ and may be amended or repealed by the sitting president at their discretion.
Fourth, command-and-control personnel during wartime, including guerilla operations like those occurring in Iraq, are
completely legitimate targets for military attack under international law.
